Definitions

This website and any associated websites and sub-sites (“Site”) along with its Content are owned and operated by Danielle Doerksen operating as AgRoster (the “Company,” “we,” “us,” or “our”), based in the Province of Alberta, Canada.

The term “you” shall refer to the user and/or viewer of this Site, including both farm operators and agricultural workers.

The term “Content” shall refer to any and all written, visual, video and/or audio information or material contained on the Site, including but not limited to all emails received from the Company, worker profiles, job postings, messages, graphics, images, forms, documents, and the like.

The term “personal information” may include but is not limited to: your name; email address; phone number; billing and payment information; work history, skills, and certifications (for workers); farm operation details (for farm operators); resume or uploaded documents; and your communications sent to us.

The term “non-personal information” may include but is not limited to: your Internet Protocol (“IP”) address; the time, date and length of your visit; traffic data; the referring website; browsing and navigation patterns; browser type; device information; and log files.

Introduction

As the owner of this Site, we understand that your privacy is of critical importance. We are committed to using your personal and non-personal information in a reasonable and responsible manner in compliance with Canada’s Personal Information Protection and Electronic Documents Act (“PIPEDA”) and Alberta’s Personal Information Protection Act (“PIPA”). The purpose of this Privacy Policy is to inform you about how we collect, use, protect and/or distribute your personal and non-personal information.

We will not collect, use or disclose your personal and non-personal information for any purpose other than as set forth in this Privacy Policy. Additionally, we will not collect more information than is necessary to accomplish those purposes set forth in this Privacy Policy, and will not retain said information longer than is necessary to fulfill said purposes.

What Personal Information We Collect and Use

We collect your information in two ways: (1) personal information that you have voluntarily provided to us; and (2) non-personal information that is automatically collected using data collection technology.

Personal Information Provided by You:

Worker Account Information: When you create a worker account, you may provide your name, email address, phone number, location, work history, skills, certifications, availability, and any resume or supporting documents you choose to upload. We use this information to create and maintain your worker profile, match you with relevant farm operators, and notify you of job opportunities and connection requests.

Worker Profile Visibility. Worker profiles are anonymous by default. Your name is only displayed to farm operators if you enable the show_name setting in your profile. Regardless of this setting, your work history, skills, location region, and availability are visible to farm operators subscribed to AgRoster. Your full contact details (email address and phone number) are only shared with a specific farm operator after a mutual connection is established or after you submit a job application to that farm.

Worker Resume and Documents. Any resume or document you upload to AgRoster is stored securely. Resume data is only shared with farm operators with whom you have applied for a position or established a mutual connection. We do not share your resume with any third parties outside of these circumstances.

Farm Account Information: When you create a farm operator account, you may provide your farm name, contact name, email address, phone number, location, operation type, and subscription details. We use this information to operate your account, display your farm profile to workers, and manage your subscription and billing.

Communication with Us: If you communicate with us via email or other form of communication, we will collect your personal information. We use this information to facilitate communication with you, respond to inquiries, provide support, and maintain our records.

Payment Information: Farm subscription payment and billing information is collected and processed by Stripe, our third-party payment processor. We do not retain nor have access to your full payment card information. Stripe handles all payment data in accordance with PCI DSS standards. We use your billing information to manage your subscription and process payments. Worker accounts are always free and no payment information is collected from workers.

Use of our Site: If you are browsing the Site as a visitor, you are not required to provide personal information to do so.

By voluntarily providing your personal information to us, you are providing consent for us to use, collect and process said information.

Non-Personal Information Collected Using Data Collection Technology:

We automatically collect non-personal information regarding your activity on our Site using session cookies. We use this information to maintain and improve our Site and enhance your user experience. We will not use your IP address to personally identify you.

How We Use Your Personal and Non-Personal Information

We use your personal and non-personal information to operate our Site, conduct business operations, and improve your experience, including:

Service Operations: We use your information to match workers with farm operators, facilitate job applications and connection requests, send job alerts and digest emails, and operate the AgRoster platform.

Profile Display: Worker profile information is displayed to subscribed farm operators in accordance with the sharing rules described in this Privacy Policy. Farm profiles are displayed to workers browsing job postings or the farm roster.

Customer Service and Communication: We use your information to provide customer service, process your requests, and communicate with you about your account.

Fulfilling Obligations and Legal Compliance: We use your information to fulfill contractual obligations, enforce our Terms of Service, and comply with legal requirements including PIPEDA and Alberta PIPA.

Security and Detection: We use your information to detect and prevent any illegal or unauthorized activities on our platform.

Disclosures of Your Information: We may disclose your information in the following circumstances: in the event of a merger, acquisition, or asset sale (with prior notice to you); if required by law or by valid requests from public authorities; or if necessary to comply with legal obligations or protect our rights.

Canada’s Anti-Spam Legislation (CASL) Compliance

In compliance with Canada’s Anti-Spam Legislation (CASL), we only send commercial electronic messages to users who have explicitly signed up for AgRoster and expressly consented to receive communications from us. Every email we send includes a visible and operable unsubscribe mechanism. You may withdraw your consent at any time by clicking the unsubscribe link in any of our emails or by adjusting your notification preferences in account Settings, or by contacting us at support@agroster.ca. Please note that withdrawing consent may affect your ability to receive certain features of the service.

Who Has Access to Your Data

We will collect, use, share and otherwise process your personal and non-personal information in accordance with this Privacy Policy. We will not sell, trade, share or otherwise disclose your personal information to unrelated third-parties without your prior written consent or another valid basis as permitted by law.

We engage the following third-party service providers to assist us in providing our services. Each of these providers may have access to your personal information solely for the purpose of performing their services:

  • Supabase — database hosting and storage, hosted on Amazon Web Services (AWS) infrastructure;
  • Stripe — payment processing and subscription management for farm accounts;
  • Resend — email delivery services;
  • Vercel — website and application hosting.

Each of these providers operates independently and is bound by their own privacy policies and data protection obligations. We recommend reviewing their respective privacy policies.

Data Stored Outside Canada

Please be aware that our third-party service providers, including Supabase (hosted on AWS) and Vercel, may store and process your personal information on servers located outside of Canada, including in the United States. Data protection and privacy regulations in other jurisdictions may not be equivalent to the level of protection provided under Canadian law. By using our Site and services, you unequivocally agree to the transfer, processing and storage of your personal and non-personal information outside of Canada, and that Canadian laws will govern our collection and processing of your information.

Cookies Policy

A cookie is a text file containing an identifier that is sent by a web server and stored by your browser. We use session cookies for the following purposes:

  • Authentication — we use cookies to identify you when you visit our Site and as you navigate our Site;
  • Security — we use cookies as a security protocol to protect your account and prevent fraudulent use of login credentials.

We do not use advertising, tracking, or marketing cookies of any kind. Please note that disabling cookies may prevent you from logging into your account and using certain features of our Site.

Retention and Protection

We will retain your personal information for as long as your account remains active. Upon receipt of a valid deletion request, we will purge your personal information from our active systems within thirty (30) days. You may submit a deletion request at any time by contacting us at support@agroster.ca. We will process your request within thirty (30) days.

We use the following safeguards to protect your personal information: HTTPS/TLS encryption for all data transmitted to and from our Site; access controls limiting who can access your personal information; secure storage of uploaded resume and document files; and commercially reasonable industry-standard security practices. You acknowledge that we cannot prevent all misuse and unauthorized access to your personal information.

Should a data breach occur that poses a real risk of significant harm to you, we will promptly notify you and the Office of the Privacy Commissioner of Canada within a reasonable timeframe as required by PIPEDA.

Password Use and Protection

You are required to create an account with an email address and password to access our Site and services. You are solely responsible for maintaining the confidentiality of your account login credentials and for any activities that may occur through your account. We are not liable for any unauthorized use of your account due to the unauthorized use of your login credentials. We highly recommend that you log out of your account after each session.

You Are in Control

You have the right to access, rectify, update, or delete your personal information at any time. To exercise these rights, please contact us at support@agroster.ca. We will process your request within thirty (30) days. Note that we reserve the right to refuse your request should we believe the requested changes to be false, incorrect, or fraudulent in nature.

Workers may control their name visibility through the show_name toggle in their profile settings at any time. You may also update or remove your profile information, work history, and uploaded documents through your account settings.

To unsubscribe from email notifications or digest emails, click the unsubscribe link at the bottom of any email we send you, or adjust your notification preferences in account Settings. If you experience any issues, please contact us at support@agroster.ca.

Personal Information Protection and Electronic Documents Act (PIPEDA) and Alberta Personal Information Protection Act (PIPA)

PIPEDA and Alberta PIPA protect personal information belonging to Canadians and Albertans respectively. These laws provide that we may collect, use or disclose your personal information in a commercial setting only for the purposes that a reasonable person would consider appropriate under the circumstances. Consent may be express or implied and may be withdrawn at any time, subject to legal requirements, contractual obligations and/or reasonable notice.

This Privacy Policy is compliant with PIPEDA and Alberta PIPA. You have the right to file a complaint regarding our privacy practices with:

Territories

Our operations are based in the Province of Alberta, Canada. Our third-party service providers may process data on servers located outside Canada, including in the United States. By visiting our Site, you unequivocally agree to us collecting and processing your personal and non-personal information in Canada and potentially other jurisdictions through our service providers, and that Canadian federal and Alberta provincial laws will govern such collection and processing.

Children’s Privacy

Protecting the privacy of minors is important to us. Our Site, Content and Services are not directed to persons under the age of 18. We do not knowingly collect personal information from anyone under 18 years of age. If you are a parent or guardian and believe your child has provided us with personal information, please contact us at support@agroster.ca and we will delete that information promptly.

Changes to This Privacy Policy

We reserve the right to change, modify, revise or amend this Privacy Policy at any time. Should any material changes occur, we will notify you via email at least thirty (30) days before the changes take effect. The most recent version will always be posted on our Site. By continuing to use our Site or services after the effective date of any changes, you are deemed to have consented to the revised Privacy Policy.
